For purposes of these Terms, “Site” or “Website” refers to Codelita LLC’s (“Company”, “we”, “us”, “our”) website, which can be accessed at www.codelita.com. “Service” refers to the Company’s services accessed via the Site or through our application (the “App”) on your device, in which users can learn programming. “You” refers to you, as a user of our Site or our Service.
We collect “Non-Personal Information” and “Personal Information.”
Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit, and preferences that are generated based on the data you submit and the number of clicks.
Personal Information means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information includes, but is not limited to, the following: (i) Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers. (ii) Any categories of personal information described in subdivision (e) of California Civil Code Section 1798.80. (iii) Characteristics of protected classifications under California or federal law. (iv) Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. (v) Biometric information. (vi) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an Internet Web site, application, or advertisement. (vii) Geolocation data. (viii) Audio, electronic, visual, thermal, olfactory, or similar information. (ix) Professional or employment-related information. (x) Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, 34 C.F.R. Part 99). (xi) Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
To activate the Service you do not need to submit any Personal Information other than your email address, your name, and your date of birth, and your zip code. To use the Service thereafter, you do need to submit further Personal Information which may include your contact information.
However, in an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you.
The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.

In addition to the information provided automatically by your browser when you visit the Site, to become a registered member of the Service you will need to create a personal profile. You can create a profile by registering with the Service and entering your email address, your birth date, your zip code, and creating a user name and a password.
The Site and the Service are not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13, or allow anyone under the age of 13 to sign up for the Service. We have strict implementations to comply with the Children's Online Privacy Protection Act ("COPPA").
In the event that we learn that we have gathered Personal Information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.
We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.
We may share aggregated information that includes non-identifying information and Log Data with third parties for industry analysis, demographic profiling, and to deliver contextual advertising about other products and services.
We employ third-party companies and individuals to facilitate our services (such as maintenance services, database management, web analytics, and improvement of our Services' features), to provide the services on our behalf, or to assist us in analyzing how Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
We may disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law) or respond to a court order, judicial or other government subpoenas, or warrants in the manner required by the requesting entity.
We also reserve the right to disclose information that we believe, in good faith, is appropriate or necessary to take precautions against liability; protect us from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Services or Site; enforce our Terms of Service; or to protect the rights, property, or personal safety of us, our users, or others.
In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred.
If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt-out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.
Your information may be transferred to - and maintained on - computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.
We implement security measures designed to protect your Personal Information from unauthorized access. Your account is protected by your account password and we urge you to take steps to keep your Personal Information safe by not disclosing your password and by logging out of your account after each use.
We further protect your information from potential security breaches by implementing certain technological security measures including encryption and firewalls. We store Personally Identifiable Information (PIIs), including but not limited to first name, last name, and email address, in an explicitly encrypted manner in our servers.
However, these measures do not guarantee that your Personal Information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.
You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt-out of further promotional communications by following the unsubscribe instructions provided in each promotional email. You can also indicate that you do not wish to receive marketing communications from us in the Settings section of the Site.
Please note that unsubscribing from marketing emails may take up to 3 days to be effective.
Requests for a copy of the information Codelita has about your account—including EU General Data Protection Regulation (GDPR) data subject access requests and California Consumer Privacy Act (CCPA) consumer information requests—can be submitted to email@example.com.
All other data subject and consumer requests under data protection laws should be sent via email to firstname.lastname@example.org from the email address that you have verified with your Codelita account.
Before we process a request from you about your Personal Information, we need to verify the request via your access to your Codelita account or to a verified email address associated with your Codelita account. You may also designate an authorized agent to exercise these rights on your behalf. Codelita does not discriminate against users for exercising their rights under data protection laws to make requests regarding their Personal Information.
As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain.
We encourage our users to read the privacy statements of other websites before proceeding to use them.
Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
